Who sets work week schedule; the Town board or Highway Superintendent?
There are three different answers to the question.
- If you have a contract with the employees that mentions hours and availability, setting hours would need to be part of the negotiations for the contract.
- Otherwise it depends upon who is the official hiring the employees.
- Highway workers hours are set by the Highway Superintendent.
- Any office personnel hours (other than the Highway Superintendent) are set by the Town Board.
It is possible (and there are examples) of the highway crew working four 10-hour days and the office personnel working five 8-hour days.
