Safety Vest and Hard Hats

Question: Is there a law requiring Highway/DPW workers to wear safety vests and hard hats?

Answer: 

• Vests are required as part of the MUTCD. Here is the interpretation letter that may provide some context.
• Hard hats are slightly different. They are required on any work with federal aid and within the State ROW. They are also required when there is overhead work. This can include trucks carrying stone as the stone can come off the truck and strike the employee.
• OSHA recommends that workers in the construction industry wear safety helmets, similar to those used for bicycling.
